Application for Admission Withdrawn crossing to US?
Hello, I recently made a trip from Los Angeles to Tijuana and then tried to enter back into Los Angeles with my B2 visa but the custom agent revoked my visa and gave me a paper titled “Withdrawal of Application for Admission”. Their reasons were: Fraud (because I had a cali drivers license, library card etc all of which was issued to me through a legitimate consular card thus all were issued to me in a non-fraudulent manner) and Intention to Immigrate (they obviously thought this for the above reasons all though it is completely untrue as I own property, conduct all my business, and live most of the year in Mexico and intend to maintain my Mexican citizenship). I am wondering what forms exist that I can fill to reverse this unfair sentencing. I imagine there is some sort of process or pardon I can ask for, some sort of form I could fill or letter I could write to clarify this case of misunderstanding.
Which waiver would I use?
Well, let’s start with your description of your trip, “I recently made a trip from Los Angeles to Tijuana and then tried to enter back to Los Angeles with my B2 visa.” You make it sound like you’re living in Los Angeles and vacationing in Tijuana. If that is the case, then he should have revoked your tourist visa. Tourist visas are not issued to live in the US and vacation in your home country. Why do you have a California driver’s license if you don’t live in California? Why would you need one? So, immigration’s decision sounds more than reasonable based on the facts you’ve laid out so far. Plus, your entries and exits into the US would have been available to the immigration officer at the time he made that decision, although I can’t guarantee he looked at them.
You won’t be able to contest the immigration decision on your own. You could hire an immigration lawyer to represent you at considerable cost and no guarantee of a favorable outcome. But if you really want to contest this, that is where you should start.
If they actually found you ineligible based on fraud grounds, 6C1, then that it a permanent ineligibility. If immigration doesn’t remove the finding, you would have to get a waiver before you could be considered for another visa.
Edit: As far as waivers go, things will depend on which grounds you were denied under. If you were simply denied as an intending immigrant, you won’t need a waiver. if it is something more serious, like fraud, you will. However, before you can actually file the waiver, you have to be considered approvable for a visa. At the moment, I think you’ll find it pretty difficult to convince a consular officer that you aren’t an intending immigrant, so if you apply for a tourist visa, you’ll more likely than not be turned down 214b and you won’t get a chance to even ask for a waiver. Still, that will be up to the consular officer, so who knows? If you can qualify for some other type of visa, it may be easier to get to the waiver stage.
If you want to contest the immigration officer’s decision directly, then you really should get an attorney, because it will probably be pretty hard to convince immigration that this is their mistake. But that’s up to you and it will depend to some extent on how much this is really worth to you. At the moment, you don’t seem to have any easy options, in my opinion.
