Tax filed as a Australian Trust or US LLC?

We are Australian citizens with an LLC set up in Wyoming, this LLC is owned by our Australian trust.

Last year our US accountant filed a tax return in the name of the Australian trust for interest earned by the US LLC. Didn’t do one for the LLC.

The LLC did no business, just earned some interest on money deposited in a US bank. This money was retained by the LLC, it didn’t go to the trust.

This seems a bit odd to me – doesn’t the LLC need to file – rather than the trust?

Also, the CPA filed the return with the trust as a “single person” on the form, is this correct?

It is a little hard to get reliable info on this stuff here, and doing it long distance is equally difficult.

An LLC is a “disregarded entity” for tax purposes at the Federal level in the US. That means that tax returns are filed as if the LLC did not exist. Since a trust “owns” the LLC, a trust return is the correct return to file. And as an LLC is a single entity then that single entity is correctly shown on the return.

From a legal perspective, corporations, trusts, estates, partnerships, etc. are indistinguishable from a person. So much so that the law had to come up with a new term for humans, i.e. “natural person,” when it becomes important to distinguish ourselves from other legal entities.
